Abstract

For the people, the pursuit of truth is a daily commitment, which is evidenced in every event that finds place in the scenario of reality, over a period of time. When this fact is not argued, the human beings accept the event as part of the past and the case is closed, but in case of doubt or confrontation, it emerges the need to turn to the judicial authorities in order to settle the dispute within the framework of what the rule of law guarantees. In view of this situation, the following doubt rises: what legal norm is to apply in penal processes that investigate the alleged involvement of public officials in offences or crimes under the penal code, and related to the exercise of their constitutional and legal duties. With that in mind, the general question is: to demonstrate the truth in these cases is it enough to apply the procedural rules or can also a constitutional norm be applied? The present paper answers that question, from the perspective of article 23, second part, of the Republic of Paraguay’s Constitution.
