Considerations of judicial delay from article 314 of the Code of Criminal Procedure

After the Bicentennial of National Independence, more than ever we are facing the historical situation of rectifying or continuing a judicial behavior that has been declining. The golden age of Paraguayan Law, understand this as the time in which the Civil Code, Judicial Organization Code, Civil Procedure Code, among other laws, were approved, gave way to our days, where the laws are flipped as a random draw with coins. The interpretations of laws are made for political and economic reasons, among others, far from the ethical syllogism of the interpretation of the law. Don Quixote expressed, in his advice to Sancho when he assumed as Governor of the island of Barataria: "When equity could and should take place, do not charge the full rigor of the law to the criminal, the reputation of a rigorous judge is not better, than that of the compassionate. If perhaps you bend the rod of justice, it will not be with the weight of giving, but with that of mercy ". There is no doubt that, both in the perception of the general public and in the communication of the media, the judiciary in general is questioned for its lack of professional suitability, for the lack of values, principles and for the lack of professional preparation. What's going on? Where are those guarantees and rights of honest, prompt and cheap justice?
