Abstract

The present work makes an investigation and legal analysis of the figure of the autonomous complaint in Paraguay, based on the National Constitution and current regulations in order to offer a sustained study on a controversial figure that presents positions for and against. To this end, this figure is conceptualized, its scope is described and the main actors for and against its implementation within the criminal procedure in the different legal systems are indicated. In this context, we proceed to contrast it with the Paraguayan constitutional regulations regarding the exercise of public criminal action, in order to finally conclude that in the event that it is decided to include it in national legislation, it would collide with a rule of constitutional rank, more specifically, with article 266 of the current National Constitution, which delegates to the Public Ministry the role of representing society before the jurisdictional organs of the State.
