Identity theft in social networking

This research pretends to expose identity theft and its legal treatment in Paraguay, and from that starting point, determine wether the juridical response granted to this offense is the appropriate, or a penal forsight of this type of felony is needed. The method adopted in this article is descriptive, since it seeks to make a characterization of the studied issue: cybernetic identity theft. Also, the approach of the present paper is qualitative, since it is focused on comprehending prosecutors’ investigative work in cases of identity theft in social networking, and the arguments of their investigation. All this, with the aim at finding out wether the penal response granted in these cases, has legal foundation in paraguayan penal system. The result of this research is that, identity theft in social networ king in Paraguay, represents more than the 50 % of the complaints reported at the Cybercrime Unit of the public prosecution authorities. Nevertheless, this offense is not foreseen in the current Penal Code. The conclusion of this research -se postscript- is that paraguayan State, throught its penal system, must adress the violations of the protected legal assets, caused by identity theft. As an urgent me asure to face this problem, the Public Ministry must be provided with legal tools to prosecute identity theft, by incorporating it in the Penal Code.Downloads
