This

paper

addresses

the

problems

surrounding

the

legal

defnition

of

sexual

abuse

of

children,

and

specifcally,

it

studies

and

analyzes

the

scope

of

the

paternal-flial

relationship

as

an

aggravating

circumstance

of

the

criminal

ofense.

For

this

purpose,

a

quantitative

approach

was

used,

with

a

non-experimental

design,

a

survey

was

used

as

a

data

collection

technique

and

the

instrument

was

a

questionnaire

addressed

to

justice

applicators

in

the

area

of

study,

and

the

scope

is

descriptive.

Among

the

most

important

fndings

are

that

the

acts

of

abuse

occur

in

the

family

environment,

of

which

the

vulnerability

of

the

children

is

a

key

factor.

In

this

regard,

according

to

the

results

of

the
