Analysis of drug users’ penal liability under act 1340/88

The drug users’ penal liability as a preparatory event to personal use from a national normative perspective, sets an assessment system and quantities permitted for possession, what causes problems to justice workers due to the excessive adherence to what is regulated or explicitly set, which force them to charges even against users/addicts who are found with minimum amounts of drugs, that hardly exceed the quantity permitted, which makes it difficult to implement policies oriented to the softening of a medical-health issue, at the time of treating addicts in conflict with the law. This approach questions the addicts’ penal liability, for they present behavioral disorder caused by compulsive drug use, which may come to have sufficient merit to attenuate the penal liability in the light of the article 30 of Act 1340/88.
