Incidents During the Progressive Regime of Sentence Execution in Paraguayan Legislation

This article examines incidents that arise during the progressive regime of sentence execution under Paraguayan legislation. To this end, the provisions of the 1992 Constitution of the Republic of Paraguay, the Criminal Code, the Penal Enforcement Code, and the Law on the Penitentiary System were examined. Judicial rulings issued by the Criminal. Judicial rulings issued by the Criminal Chamber of the Court of Appeals of the Capital were also analyzed as a key source for studying the institutions related to the benefits granted under sentence enforcement jurisdiction, in order to distinguish their effects and scope within the judicial and legal system. The research followed a qualitative approach
with a non-experimental design and a descriptive, dogmatic-documentary scope. The findings show
that the penitentiary regime adheres to a system of progressiveness, aiming to limit the duration of
a convict’s stay in detention centers. A central aspect is ensuring that judicial decisions comply with
the principles of humanization, gradualness, and rehabilitation. Consequently, it is concluded that the
incidents raised during the progressive execution of the sentence correspond to the fulfillment of the
objective of effective rehabilitation and social reintegration of the inmate.
