Assessment of witness testimony in oral and public hearings

The evidentiary assessment of witness testimony constitutes a central element within judicial proceedings, as witness statements enable the judge to reconstruct the contested facts and reach a well-founded conviction. This study focuses on analyzing the concepts, characteristics, and criteria guiding the evaluation of in-person witness testimony, the emergence of telematics, and their practical application in oral hearings. A qualitative, non-experimental, documentary research design with a descriptive scope is adopted, through a review of scientific research and specialized articles, allowing for a comprehensive perspective on the importance and limitations of witness testimony within the Paraguayan legal system. In conclusion, the value of testimony depends on the correct assessment of the witness’s credibility, coherence, and context. Its analysis requires a critical judgment by the judge, who must integrate the statement into the body of evidence in a rational and well-founded manner.
