Efficiency and effectiveness of the application of probation in the punishable act of Family Violence.

This research aims to demonstrate that the current approach of the Paraguayan judicial system regarding the punishable act of Family Violence is inefficient. To this end, an analysis was carried out of the causes that derive from this criminal type filed with the Directorate of Criminal Complaints of the Public Ministry - Area XII, specifically the Zonal Prosecutor's Offices of the Department of Misiones, of the Republic of Paraguay, in the years 2011, 2012 and 2013 and later the procedural exits granted more frequently to the authors were observed and it was determined under what rules of conduct they were applied, as well as the level of recidivism that they register with respect to each of the causes and, where appropriate, the inconveniences. that caused their non-compliance. On this basis, a study was carried out to identify the deficiencies presented by the current process for the investigation of this criminal type, focused on the author of the act. In this understanding, an analysis is made of the purpose of the sentence, the type of measures granted as an alternative solution to the process, the rules of conduct applied by the 50 judges, the level of control by the institutions that ensure compliance and the expected result that allows an effective punishability. In this line, the need for a public policy that invests in the social reintegration of the convicted and prosecuted that allows approaching the principle established by the Magna Carta as the ultimate goal of punishment is pointed out.
