Criminal liability of legal persons related to environmental crimes

In view of the constant and serious attacks on the environment, as well as the lack of criminal regulation of the liability of legal entities, it was considered necessary to carry out an investigation in this respect. In effect, the objective was to analyze the foundations that sustain the inclusion of the criminal liability of legal entities for environmental crimes in the Paraguayan Penal Code of 1997 through the perception of the legal professionals of the city of Encarnacion. The method is descriptive, with a mixed approach, non-experimental design and as for the scope: transversal, the data collection technique used was a survey with closed questions for the quantitative aspect and documentary analysis for the qualitative aspect. The population was made up of independent criminal lawyers (62 %) and public officials (20 %) and other ranks (18 %) with a probabilistic sample of 57 participants. The main conclusion was that the existence of administrative laws is not enough, because it is not enough to prevent actions that are detrimental to the environment. On the other hand, there is a legal vacuum regarding the inclusion of criminal liability of legal entities.
