Particularities of negligent homicide by omission in paraguayan criminal law

This research analyzes the treatment of the criminal offense of negligent homicide by omission in Paraguayan Criminal Law. It identified the necessary elements for an omission to constitute the criminal offense of negligent homicide, based on a study of Articles 15 and 107 of the Penal Code, as well as the requisite evidentiary elements to prove the existence of the offense. The study is descriptive and non-experimental in design, seeking to specify the properties of the phenomenon under study: the criminal offense of negligent homicide by omission. Employing a qualitative approach with a descriptive scope, it focuses on understanding the investigative and prosecutorial action in cases of negligent homicide by omission, to determine whether the criminal legal response provided by national legislation requires modification to ensure that an omission resulting in a person’s death does not go unpunished. The study concluded that the punishability of a negligent or careless omission that causes the death of another is regulated in the Paraguayan Penal Code. Although not explicitly stated, it is derived from a normative construction of the offense using Article 15 of the Penal Code, and its practical application was confirmed through the analysis of a case study.
