Contemporary discussion on justice: Rawls-Habermas

This paper intends to create debate about the idea of a merely procedural justice, from the evidences that come to light after the discussion on John Rawls and Jürgen Habermas theoretical suggestion: justice as a formality. Taking as a departure point, the disagreement between both authors, on the previous requirements to a proceduralism, whereby Rawls thesis is pointed out, which argues that, proceduralism is not possible without a previous acceptance of a notion of substantive ethic. For the discussion, we propose that Habermas thesis on the “ideal speech situation” can emerge as an approach to establish the real scope of democratic practices in our societies.
