Organized crime and criminal association in national legislation

This paper covers the organized crime’s terminology by means of historical review of its evolution, the current regulations and characteristics of the large criminal organizations that use methods of extortion, secretiveness, violence, and pursuit of impunity, public and private corruption, to obtain illicit benefits. The definition of organized crime established in the United Nations Convention against Organized Crime, requires the suitability of the term contemplated in the art. 239 of Paraguay’s Penal Code, in order to meet the obligation for punishing the behaviors described in the mentioned treaty. This research includes the international definition’s background, its characteristics, and also a section on how the penal type of criminal association differs from this concept which hinders the correct application of the penal type in the cases. To this end, the method used in this paper is non-experimental of descriptive scope, and qualitative approach, the technique applied was the analysis of doctrine, as well as national and international legislation regarding both meanings and their scope.
