The accountability of public notaries in the prevention of money laundering
A comparative analysis of Paraguayan and Mexican legislation

This paper’s main objective is to explore the accountability of public notaries in the prevention of money laundering, to know the scope of their functions stipulated in Paraguayan legislation, and to compare them to Mexican legislation, taking into consideration that public notaries are appointed as obliged subjects by the SEPRELAD, to act against money laundering due
to their intervention in relevant legal and economic activities in the field of assets of patrimonial assets. However, their obligations are minimal when it comes to providing information to the entities in charge of the investigation of suspicious activities. In this sense, this paper analyses the scope of that accountability, so that this information will not be used by unscrupulous clients. The applied methodology is the bibliographic review, by analyzing and comparing current normative in Paraguayan legislation to the Mexican legislation, that regulate the professional activity of public notaries as obliged subject in the prevention of money laundering. In this spirit, it can be pointed that Mexico counts with legislation that regulates the obligation to report suspicious activities.
