Perspectives and prospects of the Constitutional Jurisdiction

The theory of constitutional control within its origins, foundations, variants and application, occupies a central place in the theoretical and practical in terest of different areas of the exercise of law. The purpose of the work is to reflect and share the different challenges facing the exercise of constitutionality control and the recognition of the constitution as the supreme law. The perspective and prospective of different discussions along the evolution of the exercise of the con trol of constitutionality are addressed: political, judicial, procedural, the difficulty of institutional role of the Supreme Courts or Constitutional Courts, which refers to institutional tension; and the harshest point of the exercise of control, consisting of the analysis of a norm emanating from the reforming Constituent Power, which is described as sovereign tension; therefore, encompass the challenges that have been addressed by doctrine, jurisprudence and the political debate around the exercise of constitutional control, and structural challenges. The body in charge of such control in a democracy that faces a potentially conflicting role must be the guarantor of the Constitution as the supreme rule of the order, defending it from the violations that may be committed by political powers; and also to ensure that they can fulfill the powers of government that the Constitution itself confers.Downloads
