Analysis of the implication of dominion of the fact in economic crimes

The topic is relevant from scientific research, which is inferred with respect to the implication of the -the theory of the dominion of the fact- in the area of interest, identified as economic crimes. In this sense, the main question will guide the dogmatic analysis with a mixed approach methodology, of non-experimental design, of dogmatic type and descriptive scope, in fact, as a data collection technique a survey was used through the Google forms, addressed to 7 legal professionals with knowledge in the field of this specialized area. The categories of analysis were ordered in the processing of the variables by means of an ad hoc Likert-type scale whose results were processed in the BM SPSS Statistics software using Cronbach’s alpha to measure the reliability of the instrument used. The results show that Cronbach’s alpha coefficient can be perceived in the weighting scale with an -acceptable- score, while, in the analysis of two halves, it is deduced to have a very high value in the reliability margin. It is concluded that the Paraguayan legal system - Law n.º 1160/97 and its modifying Law n.º 3440 - carries out the dogmatic construction of the final concept of perpetrator, on the basis - of the theory of the dominion of the fact - in relation to the fraudulent action - dealing with economic crimes -; that is, any agent who externalizes his functional dominion over a financial wrong, and according to it, supports doctrinal, technological and technical knowledge for the correct execution.
