Abstract

The traditional objective of environmental norms, has been prevention of disastrous accidents and the consequences for the health, in this order or ideas, the environmental impact assesement consists of a preventive study whose aim is to identify and rate environmental impact that a certain project or productive activity shall have if executed. This is recommended and endorsed by international organizations and attested by the experience of developed countries that have included the mentioned assesement in their legal system. The foundation and goal of the Act is to protect environmental legal assets, including the right to life and health, furthermore, it is important to state that the right to a healthy environment, provided for by paragraph 7 in agreement to paragraph 8 of the National Constitution, all this, related to the right of a healthy life even when polluted environment (air, water, flora), caused by environmental damage, affect health and life of the people.
