Abstract

It is known that “gender violence is not a problem that affects the private sphere. On the contrary, it manifests itself as the most brutal symbol of the inequality that exists in our society. It is a violence that is directed at women for the very fact of being women, for being considered by their aggressors, lacking the minimum rights of freedom, respect and decision-making capacity”. With these words, the Spanish legislator manifests himself in the explanatory statement of the L.O. 1/2004 "Comprehensive Protection against Gender Violence" of Spain. This violence based on inequality occurs in any area (family, work, social, university...), sometimes manifesting an enormous contempt for women for the simple fact of being a woman. The United Nations Organization recognized, at the IV World Conference on Women, held in Beijing in 1995, that violence against women constitutes a brake on the effective achievement of equality, development and social peace. This type of violence has cultural conditions based on the superiority of the masculine gender over the feminine and violates the right to equality, as well as other fundamental rights of the person, in this case of women, such as the right to dignity, free right of personality, the rights to life, liberty, security, physical integrity, sexual indemnity.
