The application of the legal type of torture in Paraguayan criminal law

This article deals with a holistic view of the application of the punishable act of torture committed during the validity of the Paraguayan Penal Code of 1914. To this end, the applicable legal framework is analyzed: domestic law, international law and the current National Constitution, both at the time when these events occurred and today. In this understanding, the obligations contracted by Paraguay and its position regarding the imprescriptibility of punishable acts that violate human rights considered crimes against humanity are studied. These crimes mostly occurred during the government of General Alfredo Stroessner, known under the regime of a military dictatorship during the period 1935-1989. It is also intended to clarify doubts regarding the principle of legality and the principle of imprescriptibility, in an attempt, logically, to achieve the ideal of justice and guarantee access to justice as a way to avoid impunity.
