This research work arises from the current problem in terms of assistance and protection for both victims and witnesses in criminal proceedings, for which it has been necessary to analyze their current situation, taking into account the punishable acts that are generally generate the need for greater protection. It seeks to identify the existing assistance and security measures and the recommendations that may arise from the analysis of the Victim and Witness Protection programs developed by other countries. It is also intended to create awareness about the importance of protecting the victim, as well as the relevance of avoiding re-victimization, taking into account the factors that influence their behavior and the way in which these can affect criminal proceedings. It also aims to recognize the need to create empathy on the part of the agents of justice with the victims as well as with the witnesses, without this affecting the objectivity that must prevail in the actions of the Public Ministry.
