The Public Ministry as a guarantor of respect for the Human Rights of citizens

Transversality, as one of the characteristics of human rights, is a condition and its relevance in relation to the functions of the Public Ministry must be made visible. The respect, promotion and teaching of these rights must be emphasized. The Public Ministry as a representative of society, with powers established in the National Constitution aimed at guaranteeing the full validity and realization of human rights, must strengthen its strategies for the effective fulfillment of the rights of citizens, especially with respect to the dignity. This is a value inherent to the person, as provided by the Magna Carta. Within the framework of the constitutional functions, the commitments of the institution derived from the international treaties ratified by Paraguay must be included and, therefore, form part of the national positive legislation. Article 268 number 5 of the CN, establishes that the duties and powers of the Public Ministry are "... the other duties and powers established by law...". In this sense, there are countless international instruments for the protection of human rights that further compromise the action of the Public Ministry. In accordance with the constitutional provisions, the Public Ministry is governed by Law 1562/00, which emphasizes that "it is a body with functional and administrative autonomy, which represents society before the jurisdictional bodies..." For the correct application of the international legal instruments, it is necessary to take into account the differences that exist between General International Law and International Human Rights Law, because the first deals with the relationship between States, and the second has the human being as its center and recommends that human rights are inherent to the human person from its conception, taking into account its dignity.
